End-User License Agreement
This End-User License Agreement (“Agreement”) is a contract between you and Declassified Records (“we”, “us”) governing your use of the Declassified Records website (declassifiedrecords.shop) and the Declassified Records iOS app (collectively, the “Service”). By creating an account or using the Service you agree to this Agreement. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 17 years old (or the age of majority in your jurisdiction, whichever is older) to use the Service. By using the Service you represent that you meet this requirement.
2. The Service
Declassified Records is a peer-to-peer marketplace for vinyl records. Sellers list records they own; buyers purchase from sellers directly. Payment runs through PayPal between buyer and seller — Declassified does not process payments, hold funds, or act as a party to the transaction.
3. Your account
- You are responsible for activity under your account and for keeping your password secure.
- One person, one account. Don’t share, sell, or transfer your account.
- Provide accurate registration information and keep it current.
- You may delete your account at any time from Settings → Account → Delete account.
4. Acceptable use
You agree not to:
- Post listings for items you do not own or do not have the right to sell.
- List bootlegs, counterfeits, stolen goods, or items prohibited by law.
- Post content that is harassing, threatening, hateful, sexually explicit, or otherwise objectionable.
- Impersonate another person, brand, or entity.
- Spam, scrape, or send unsolicited commercial messages through the Service.
- Attempt to defraud another user, manipulate prices, or evade buyer/seller obligations.
- Circumvent the Service’s reporting, blocking, or moderation features.
- Probe, scan, or attempt to breach the Service’s security.
- Use the Service in any way that violates applicable law.
We have zero tolerance for objectionable content. Reports are reviewed and acted on within 24 hours; accounts that post prohibited content may be suspended or terminated without notice. To report content tap the more menu (⋯) on a listing, user, or message.
5. Your content
You retain ownership of the photos, descriptions, and messages you post. You grant Declassified a worldwide, non-exclusive, royalty-free licence to host, store, display, and distribute that content within the Service for the purpose of operating the marketplace. The licence ends when you delete the content or your account, except where retention is legally required.
6. Transactions between users
Buyers and sellers transact directly. Declassified is not a party to those transactions and does not guarantee item condition, delivery, or payment. We provide tools (in-app messaging, the order timeline, the “Payment received” confirmation) to help, but disputes are between buyer and seller. PayPal’s buyer protection may apply depending on how payment was sent.
7. Termination
We may suspend or terminate your account if you violate this Agreement, if continued access creates risk to other users, or if required by law. You may stop using the Service at any time and delete your account from the in-app settings.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, Declassified Records will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to the Service. Our aggregate liability for any claim related to the Service is limited to USD $100.
10. Changes
We may update this Agreement from time to time. Material changes will be notified in-app or by email at least seven days before they take effect. Continued use of the Service after a change means you accept the updated Agreement.
11. Governing law
This Agreement is governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to jurisdiction in those courts.
